    The Special Education Department at Chester works with families and the staff to meet the needs of students through Part 200 of the Commissioner's Regulations and IDEA (Individuals with Disabilities Education Act). This ensures that all students receive a free and appropriate education (FAPE) in their least restrictive environment (LRE). Students may be eligible for services between the ages of 3 and 21. A Committee on Preschool Special Education (CPSE) or Committee on Special Education (CSE) determines if a student meets the criteria for special education services through an Individualized Education Plan (IEP). 

    This office also oversees Section 504 for the district. Section 504 provides certain protections to students who may not qualify for special education. Section 504 of the Rehabilitation Act of 1973 is a federal law that probits discrimination against people with handicaps, Section 504 regulation defines an individual with handicaps as any person who may

    1. have a mental or physical impairment that substantially limites one or more major life activities; or
    2. have a record of such an impairment; or
    3. be regarded as having such impairment.

    The key factor in determining whether a person is considered an "individual with handicaps" covered by Section 504 is whether the physical or mental impairment results in a substantial limitation of one or more of the person's major life activities.
